Steven Martin and Robert Elworth obtained a summary judgement in favor of their client who was sued for failure to provide adequate coverage for a historic building in Rock Island, Illinois. The motion was initially denied but upon a motion for reconsideration the court ruled that plaintiff could not prove causation between any alleged negligence and the uninsured loss. Plaintiff's employees knew and accepted that the policy procured did not cover the existing building, only the improvements to the structure, yet did nothing for over three months prior to the fire loss.
