Tony Tunney and Jeffrey Tabares, HeplerBroom attorneys obtained a not guilty verdict today on behalf of their clients, Brett Hager and Insurance Correlators, Inc. Plaintiff claimed that Mr. Hager failed to properly obtain a jewelers' block policy for The Estate to cover the alleged jewelry sold by consignment at their store. An alleged theft on May 14, 2006 resulted in approximately $87K loss in jewelry consignments. Plaintiff also claimed she requested a policy providing retail value of the stolen items in case of a loss. Hager and ICI denied such a request and indicated they suggested jewelers' block coverage to the plaintiff, and she turned down the suggestion because she dealt in antiques and replica items. Plaintiff asked the jury for the retail value of the items, twice the replacement cost, at closing. Jury returned a verdict in less than two hours including lunch.
