Anthony Tunney and Robert Elworth, partners in HeplerBroom's Chicago office, obtained a not guilty verdict for their insurance agency client in a Cook County jury trial. The agency's client and plaintiff at trial, a national conglomerate of sterilization companies, alleged that it was misled during the policy's procurement about the business interruption/extra expense coverage's scope. When the carrier successfully denied a portion of a claim under the coverage, the plaintiff alleged it lost a primary customer. Plaintiff sought at trial in excess of $17 million in lost profits due to the customer's departure.

Tunney and Elworth garnered an Illinois Appellate Court's affirmance of a dismissal of an earlier, related case, in 2005.
