Environmental Attorneys Publish Article on Erosion of Regulated Entities’ Traditional Protections

Jennifer Martin, Alec Messina, and Michael Murphy have published an article in the Illinois Manufacturer that highlights how recent cases involving alleged violations of the Illinois Environmental Protection Act have set some alarming precedents for Illinois companies. The article details the background and ramifications of two recent cases. One case raises serious questions about the scope of liability protection afforded by Compliance Commitment Agreements and groundwater management zones. In the second case, a company operating in full compliance with an IEPA-issued air permit still faced liability issues and litigation brought by the State of Illinois. All three attorneys are partners in the firm’s Springfield office and focus their practices on environmental law. Martin represents clients in transactions involving impacted properties and enforcement proceedings related to land, waste, and water violations.
