HeplerBroom Attorney Obtains Summary Judgment for Client

Meg Fowler obtained summary judgment in the Circuit Court for the City of St. Louis. The plaintiff was a private health club who had incurred expenses in defending a discrimination case filed against it by a former employee. As the club had failed to report the claim to its insurance carrier when it received notice of the claim, there was no insurance coverage for the claim or for the defense of the claim. The plaintiff brought suit against its insurance broker alleging the broker failed to report the claim and did not have a procedure in place to report claims. On the basis that the plaintiff had not requested the broker to handle claims, the court granted summary judgment for our client.
