Dede Zupanci Prevailed Before Fourth District Court of Appeals
Dede Zupanci prevailed before the Fourth District Court of Appeals in the medical malpractice matter of Bettis v. Wade. The Fourth District affirmed the trial court's orders barring Plaintiff's expert witnesses and granting defendant's motion for summary judgment for HeplerBroom's client. The plaintiff filed suit against the defendant doctor alleging a failure to recognize signs and symptoms of a ruptured intracerebral aneurysm.
The Appellate Court agreed with the trial court, holding that the it properly barred the plaintiff's standard of care expert, and that the plaintiff failed to establish both standard of care and proximate cause through expert testimony. This is the second time Ms. Zupanci has prevailed on appeal in the Fourth District in Bettis v. Wade. Previously, the Appellate Court affirmed the trial court's order denying the plaintiff's motion to convert a Respondent in Discovery to a Defendant.
