Elworth Obtains Summary Judgment for Cook County Insurance Client
Robert Elworth recently obtained summary judgment for an insurance producer in Cook County Circuit Court. The plaintiff alleged the insurance producer had negligently misrepresented procuring building coverage for a tavern. The court determined that the tavern owner’s asserted reliance on the alleged statements about the policy was unreasonable as a matter of law. According to the court, both the application the owner signed and the policy’s declarations page plainly revealed that the policy was for business personal property only. Those documents also showed a significantly lower policy limit than the owner claimed the producer told her the policy provided.
