Overview

Charles N. Insler concentrates his practice on complex commercial litigation including;

He also has experience representing clients in various insurance matters and has defended employers against discrimination claims. Mr. Insler represents a variety of clients in both state and federal courts.

Before joining HeplerBroom, Mr. Insler worked for a boutique firm in Baltimore, litigating class action securities fraud and fiduciary duty cases in state and federal courts around the country. Before that, he served as the law clerk to a Federal Magistrate Judge on the U.S. District Court for the Eastern District of Missouri and as a staff attorney for the U.S. Court of Appeals for the Sixth Circuit.

Mr. Insler is an accomplished writer, and his works, both legal and non-legal, have appeared in national and international publications.

  • Won appeal of attorney’s fee award in Prevailing Wage Act and Wage Payment and Collection Act, along with award of appellate fees, in Third District Court of Appeals. Jones v. Brandt Constr. Co., 2022 IL App (3d) 210389-U.

  • Won summary judgment for international restaurant franchisor in wrongful death action before U.S. District Court for Eastern District of Missouri. Hersh v. CKE Rest. Holdings, Inc., No. 4:17-CV-02043-AGF, 2022 WL 407124 (E.D. Mo. Feb. 10, 2022).
  • Successfully defeated requests for injunctive relief that would have prevented Illinois Gaming Board from selecting a casino license applicant. Both Circuit Court for Cook County and First District Court of Appeals denied requests for injunctive relief.
  • Won appeal of adverse ruling in district court for valve supply company seeking coverage from its insurer before U.S. Court of Appeals for the Seventh Circuit. Federated Mut. Ins. Co. v. Coyle Mech. Supply Inc., 983 F.3d 307 (7th Cir. 2020).
  • Won $2.5 million fee award for hog farming operation under Illinois Farm Nuisance Suit Act in Circuit Court for Scott County. As part of this same case, won affirmance of jury verdict award in favor of hog farming operation and won cross-appeal to obtain attorneys’ fee award for hog farming operation in matter of first impression before Fourth District Court of Appeals in Illinois. Marsh v. Sandstone N., LLC, 2020 IL App (4th) 190314, appeal denied, 163 N.E.3d 745 (Ill. 2021).

  • Defeated qualified immunity challenge while representing plaintiff, pro bono, in excessive force claim before U.S. Court of Appeals for the Eighth Circuit. Graham v. St. Louis Metro. Police Dep't, 933 F.3d 1007 (8th Cir. 2019).

  • Won significant arbitration award, along with award of attorneys’ fees, for private investor in FINRA arbitration proceeding against major brokerage firm and its registered representative.

  • Obtained affirmance of dismissal and obtained attorneys’ fee award for pharmaceutical company against Fortune-50 food production company in breach of contract action before U.S. Court of Appeals for Seventh Circuit. ADM All. Nutrition, Inc. v. SGA Pharm Lab, Inc., 877 F.3d 742 (7th Cir. 2017).

  • Obtained dismissal on personal jurisdiction grounds for auto parts manufacturer in copyright and trademark infringement action in U.S. District Court for Eastern District of Missouri. etrailer Corp. v. Automatic Equip. Mfg, Co., No. 4:17-CV-1309 HEA, 2018 WL 1535473 (E.D. Mo. Mar. 29, 2018).

  • Discovered identity of anonymous Yahoo! email address associated with defamatory and disparaging emails in Rule 224 action in Peoria County, Illinois.

  • Successfully represented brokerage firm on appeal to Fifth District Court of Appeals in Illinois, with court holding that trial court erred when it failed to enforce client’s arbitration clause.  Ward v. Hilliard, 2018 IL App (5th) 180214.

  • Defeated class certification in action for sexual discrimination brought by professor of medicine against state university medical school.

  • Successfully represented aircraft inspection company against claims it failed to discover and deficiencies in private jet. JR14, LLC v. Jetcorp Tech. Servs., Inc., No. 4:17-CV-1469 RWS, 2017 WL 3720075 (E.D. Mo. Aug. 29, 2017).

  • Defeated plaintiff’s motion for class certification and subsequently won summary judgment in case involving allegations of unauthorized practice of law in Circuit Court for Cole County, Missouri. Lucas Subway MidMo, Inc. v. Mandatory Poster Agency, Inc., 524 S.W.3d 116 (Mo. Ct. App. 2017).

  • Won expedited parole hearing for prisoner in pro bono representation where parole board could not consider certain adverse evidence in U.S. District Court for Eastern District of Missouri. Murphy v. Missouri Dep't of Corr., No. 2:84-CV-92 (CEJ), 2016 WL 659023 (E.D. Mo. Feb. 18, 2016).

  • Successfully defended individual accused of breaching his employment agreement with multi-national equipment rental company in Circuit Court for Orange County, Florida.

  • Successfully defended genomics company in sexual harassment and constructive discharge case in Circuit Court for St. Louis City, Missouri.

  • Successfully defended real estate brokerage company accused of violating Missouri Merchandising Practices Act in proposed class action in Circuit Court for St. Louis County, Missouri.

  • Won dismissal for failure to state a claim for law firm accused of price-fixing and other antitrust violations in Circuit Court for St. Louis County, Missouri.

  • Obtained dismissal with prejudice for national federal loan servicer accused of violating Telephone Consumer Protection Act in U.S. District Court for Eastern District of Missouri.

  • Successfully defended franchise in enforcing its arbitration clause and compelling arbitration in appeal to U.S. Court of Appeals for Eighth Circuit. Torres v. Simpatico, Inc., 781 F.3d 963 (8th Cir. 2015).
