CMS Issues Long-Awaited Final Rule Imposing Civil Money Penalties for Failing to Properly Report Pursuant to Medicare Secondary Payer Obligations

On October 11, 2023, the Centers for Medicare and Medicaid Services (CMS) published in the Federal Register its Final Rule detailing the circumstances when civil money penalties (CMPs) will be imposed for failure to properly report claims of Medicare beneficiaries as required under the Medicare, Medicaid, and SCHIP Extension Act (MMSEA) of 2007. The Final Rule becomes effective on December 11, 2023, and will be applicable on October 10, 2024.
